“I think this bill is dangerous. A new regulator could make rules that hurt small inventors and protect big medical tech companies. Health care also belongs to the provinces under the Constitution, not the federal government.”

Madam Speaker, I think it is dangerous. There are two major dangers that I see. One is to free enterprise. If we have some giant regulator, unaccountable to the House, making decisions about what constitutes interoperability, how is that going to affect my friend? He is a professor of medicine. He is, frankly, a genius. He is trying to develop this ultrasound AI-powered technology. It would be easy for the regulator to put restrictions on him that would make it almost impossible for him to enter the market unless he lives up to the standard that the fat cats like Cerner and Meditech get the regulator to adopt. There is a real risk of protectionism and the choking out of health care innovation. I have read the Canadian Constitution front to back a few times. It talks about hospitals being under provincial jurisdiction. We have the Public Health Agency, we have Health Canada, and we have the Canada Health Act. It seems that in many ways in this country, health care currently comes under federal jurisdiction, and the words “health care” do not appear in Canada’s written constitution, at least.
