First Nations Clean Water Act

Bill C-37, First Nations Clean Water Act · Second reading · now at committee in the House Where it stands

What Bill C-37 would do

The bill would affirm that the right to self-government includes First Nations jurisdiction over drinking water, wastewater, source water, and related infrastructure on their lands. It would set minimum standards for water quality, water quantity, and wastewater effluent. The bill would also establish guiding principles like substantive equality and create pathways to help protect source water.

“I want to know what the member thinks about the bill using the phrase 'best efforts'. The government promises to try its best, but it makes no real promises. Can we trust them?”

Madam Speaker, I would like to thank my colleague from Saanich—Gulf Islands for her comments. I would like to know what she thinks of the phrase “best efforts”. It keeps cropping up in the bill. How much confidence does she have in this oil-friendly government, which says it will do its best without any concrete commitment from the minister?

“I want to ask the member how First Nations leaders are responding to this water bill. The old bill was made together with First Nations. The government wrote this new one on its own, and it takes away basic First Nations rights.”

Official Hansard

Madam Speaker, I would like to thank my colleague from Winnipeg Centre for her ongoing commitment to first nations’ rights and to ensuring that their voices are heard, respected and recognized. Of course, this is one of the problems we have with Bill C-37. I would like to hear her talk about mobilization and how first nations and their leaders are receiving this bill. I would remind members that the previous version of this bill was co-developed, whereas this one stems essentially from the wishes of the Minister of Indigenous Services and the Prime Minister, who wanted to intervene to remove some of first nations’ fundamental human rights.
